Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the BeBay website and booking platform (“BeBay”, “we”, “us”), operated by BeBay d.o.o., a company registered in Montenegro with its registered office at Palih boraca 18, 85320 Tivat. Please read them carefully before using the platform or making a booking.

By using BeBay, submitting a booking request, or ticking the box to accept these Terms, you confirm that you have read, understood and agree to be bound by them. If you do not agree, please do not use the platform.

1. Who we are and what BeBay does

BeBay operates an online platform that helps travellers in Montenegro discover, request and pay for water taxi transfers and boat experiences provided by independent, licensed boat operators (“Operators”).

BeBay is a booking and payment intermediary. Except where we expressly state that BeBay is the direct operator of a particular service (see Section 4), we are not the carrier, tour organiser or provider of the boat service itself, and we do not own or crew the vessels.

2. Our role as intermediary — who your contract is with

When you book a water taxi transfer or an experience through BeBay, the contract for that service is concluded directly between you and the independent Operator who performs it. BeBay acts as a disclosed intermediary that arranges the booking and payment on the Operator’s behalf.

This means the Operator — not BeBay — is responsible for performing the service, for the safety and seaworthiness of the vessel, for its crew, and for compliance with the maritime and licensing rules that apply to it. Before your trip we will identify the Operator responsible for your booking.

  • BeBay is responsible for the booking and payment platform itself and for the accuracy of the information we present.
  • The Operator is responsible for the boat service, its safety and its performance.

3. Eligibility

You must be at least 18 years old and able to enter into a binding contract to make a booking. If you book on behalf of other passengers, you confirm that you are authorised to do so and that you will share these Terms and any safety information with them.

4. When BeBay is the direct operator

For certain routes or services, BeBay may act as the direct operator rather than as an intermediary. Where this applies, we will make clear at the time of booking which company is providing the service. In those cases BeBay is your contracting party for that booking and assumes the corresponding carrier and consumer-law obligations directly, while the rest of these Terms continue to apply.

5. Bookings, quotes and confirmation

You choose your trip details (such as pick-up and drop-off points, date, time and number of passengers) and submit a booking request. Any price shown before confirmation is an estimate; the final price is set and confirmed by the Operator.

A booking is confirmed only once the Operator accepts it and you receive a confirmation from us. We or the Operator may decline or be unable to fulfil a request — for example, where no suitable vessel is available.

6. Prices and payment

Prices are shown in euros (EUR) and, where applicable, include taxes.

You can pay by VISA, Maestro or MasterCard cards that support online payments. Card payments are handled through the PrestoLink service, owned by Fleka in cooperation with NLB a.d., and are processed securely through the certified Bankart Payment Gateway. The amount is charged to your account within 24 hours of you completing the payment, and BeBay does not store your full card details.

You are responsible for checking with your card-issuing bank whether your card supports online payments.

Any additional charges agreed directly with the Operator on the day — for example extra waiting time or itinerary changes — are a matter between you and the Operator.

7. Cancellations, changes and refunds

Our cancellation and refund policy is as follows: Water taxi transfers can be cancelled free of charge, with a full refund, if you cancel more than 48 hours before the scheduled pick-up; within 48 hours of pick-up they are non-refundable. Boat experiences can be cancelled for a full refund up to 24 hours before the experience; within 24 hours they are non-refundable. Approved refunds are returned to your original payment method. Because trips run on a specific date and time, cancellation terms become stricter the closer they are to departure.

If the Operator cancels a confirmed trip, or it cannot go ahead for reasons of weather or safety (see Section 9), you will be offered a reschedule or a refund of the amounts you paid through BeBay for that trip, in line with that policy.

8. Right of withdrawal (cooling-off period)

Under Montenegrin consumer-protection law, the 14-day right of withdrawal for distance contracts does not apply to leisure, transport and similar services that are to be provided on a specific date or within a specific period. Water taxi transfers and boat experiences booked for a specific date or time therefore fall within this exception.

This means that once your booking is confirmed you do not have a statutory 14-day right to cancel for a refund. Your cancellation rights are instead those set out in our cancellation policy (Section 7). We draw your attention to this so that you are aware of it before you book.

9. Safety, weather and force majeure

The Operator’s captain has final authority over whether a trip can take place safely, including decisions about weather, sea conditions and routing. A trip may be cancelled, shortened, delayed or re-routed for reasons of weather, sea state, mechanical failure, official instructions or other events beyond reasonable control (“force majeure”).

Where a trip cannot safely take place, the consequences (reschedule or refund) are those set out in Section 7. Neither BeBay nor the Operator is liable for losses caused by events of force majeure, beyond what mandatory law requires.

  • Follow the crew’s safety instructions at all times.
  • Tell us in advance if any passenger is a child, a non-swimmer, pregnant, or has a relevant medical condition, so the Operator can provide appropriate safety equipment.
  • The Operator may refuse carriage to anyone who is intoxicated or whose behaviour endangers safety.

10. Operator obligations

We require Operators to warrant that they hold all licences and permits needed to carry passengers in Montenegro, that their vessels are registered, seaworthy and insured (including any compulsory passenger-liability insurance that applies), that their crews are appropriately qualified, and that they comply with applicable maritime safety rules. Operators indemnify BeBay against losses arising from a breach of these obligations.

11. Your responsibilities as a passenger

  • Provide accurate booking and contact details.
  • Arrive at the agreed pick-up point on time.
  • Carry any travel documents needed for your journey.
  • Behave safely and considerately, and follow the crew’s instructions.
  • Remain responsible for any children in your party at all times.

12. Liability

BeBay is responsible only for the proper functioning of its own booking and payment platform. We are not liable for the performance, acts or omissions of an Operator, except where we act as the direct operator under Section 4.

The Operator’s liability for the carriage of passengers and their luggage is governed by the maritime law applicable to the trip, which may limit the amount of compensation payable. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under mandatory law, including liability for death or personal injury caused by negligence, for fraud, or your rights as a consumer.

13. Intellectual property

The BeBay name, logo, website and content are owned by BeBay or its licensors and are protected by law. You may use the platform for your own bookings but may not copy, reproduce or commercially exploit it without our permission.

14. Privacy

We process personal data in accordance with our Privacy Policy, which explains what we collect, how we use it and your rights. Please read it together with these Terms.

15. Governing law and disputes

These Terms are governed by the laws of Montenegro, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence. The courts of Montenegro have jurisdiction, again without prejudice to those mandatory rights.

If you have a complaint, please contact us first so we can try to resolve it. As a consumer you may also have access to out-of-court dispute resolution; consumers in the EU can use the European Commission’s Online Dispute Resolution platform.

16. Changes to these Terms

We may update these Terms from time to time. The version that applies to your booking is the one in force when you make it. We will post the current version on this page together with the date it was last updated.
